Reservation Agreement

  1. RENTAL PERIODS are for a minimum of three (3) nights during peak seasons, except for certain units which require a seven-night minimum.  Please note:  your online reservation for less than seven nights is subject to seasonal restrictions and minimum booking guidelines.  If your online reservation is booked for more than one year in advance, those dates may not be available.  No minimum during off seasons.  All reservations are subject to a departure housekeeping charge.  Housekeeping charges are in addition to published rental rates and are also subject to 11% tax. Housekeeping charges are payable at the same time as unit rental fees.  Monthly reservations are subject to one housekeeping charge only.  The housekeeping fee is payable at time of check-in with payment of first month's rent.
  2. DEPOSITS. A booking deposit of $200 plus a $30 non-refundable reservation processing fee is due within 5 days of making your reservation. The $200 booking deposit is applied to the rental amount which is due upon arrival. Credit cards may be used for the deposit and processing fee as well as personal checks. Deposits not received within 5 business days of booking will cause the reservation to be cancelled. Reservations made 14 days or less prior to the arrival date require the deposit be made with a credit card.  We accept MasterCard, VISA or American Express. Sorry, we do not accept Discover.
  3. CANCELLATIONS. Cancellations must be made 15 days prior to arrival in order to receive a refund. All cancellations are subject to a $25 cancellation fee. Cancellations less than 15 days prior to arrival forfeit the booking deposit. All monthly cancellations are subject to a $25 cancellation fee, and cancellations less than 60 days prior to arrival forfeit the booking deposit.
  4. EARLY DEPARTURE. SORRY, THERE CANNOT BE REFUNDS FOR EARLY DEPARTURE OF GUESTS.
  5. FURNISHINGS. All units are furnished. Furnishings vary from unit to unit due to individual taste of owners. All equipment in units should be in working order. Please report any inoperative equipment to our office promptly. We will make every reasonable effort to have the problem corrected. Under no circumstances will there be a reduction of rent for any mechanical failure of air conditioning, dishwasher, washer, dryer, TV, VCR, blender, toaster or other appliances.
  6. LINENS. Linens are provided in the units when you arrive. NO LINENS WILL BE EXCHANGED DURING YOUR STAY. Initial supplies of bath soap and toilet tissue are also provided in unit. Other than the initial supply of bath soap and toilet tissue, NO ADDITIONAL PAPER PRODUCTS OR SOAP WILL BE PROVIDED. We suggest you bring Beach Towels or Blankets, as we do not permit linens to be taken out of the units. Linens are NOT provided for winter monthly rentals, but are available for an additional fee.
  7. PETS. SORRY, ABSOLUTELY NO PETS ARE ALLOWED IN ANY RENTAL UNIT. Violation of this policy will result in eviction and forfeiture of rent and deposit.
  8. RISK & LIABILITY. By renting this property, you are assuming all risk and liability for any damage or excessive wear and tear to the unit. Any damage will be charged to the rental guest. We ask that you help us maintain the property in good condition for your enjoyment and those guests who follow.
  9. SUBSTITUTION. We reserve the right to substitute comparable accommodations without notice or liability should the unit become unavailable for any reason. When comparable accommodations are not available, renter will have the option of selecting from available properties at the published rate or receiving a complete refund of the reservation deposit.
  10. RENTAL PAYMENT. Your total rental payment is due upon arrival, unless you have prepaid. Golf packages must be paid in full 30 days prior to arrival. We accept cash, travelers checks, money orders, cashier's checks, certified checks, personal checks with proper identification, MasterCard, VISA or American Express. Sorry, we do not accept Discover. (Credit cards cannot be accepted for monthly rental payments.) For the convenience of all our guests, WE REQUIRE ONE CHECK OR ONE CREDIT CARD FOR RENTAL PAYMENT UPON ARRIVAL.  There will be a $25 charge for returned checks.
  11. STUDENTS. ABSOLUTELY NO UNIT WILL BE RENTED TO VACATIONING STUDENTS WHO ARE NOT ACCOMPANIED BY A PARENT. Parents must be actually staying in the unit with the students the entire length of the reservation. Failure to comply will result in parties being asked to leave the property with forfeiture of deposit and rent.  NO ONE UNDER 21 YEARS OF AGE WILL BE ALLOWED TO REGISTER!!
  12. WITHHOLDING DEPOSITS. This property is privately owned and managed and WE RESERVE THE RIGHT to withhold deposits, refuse rental or discontinue occupancy if in our judgment your occupancy of the unit is detrimental to the property. BENDER REALTY, INC. reserves the right to alter reservations of units in the event of scheduling conflicts, repairs/maintenance, or other circumstances beyond our control. A comparable substitution will be made whenever possible.  We reserve the right to enter the premises at any time for the purpose of inspection, repair, management or showing to prospective buyers.
  13. RATES. ALL RATES ARE SUBJECT TO CHANGE WITHOUT NOTICE.  Rates are subject to lodging tax. Failure to vacate a unit by check-out time may result in an additional day's rent being charged.
  14. OCCUPANCY.  MAXIMUM OF FOUR (4) PERSONS PER 1-BEDROOM UNIT.  MAXIMUM OF SIX (6) PERSONS PER 2-BEDROOM UNIT.  MAXIMUM OF EIGHT (8) PERSONS PER 3-BEDROOM UNIT.  MAXIMUM OF TEN (10) PERSONS PER 4-BEDROOM UNIT.
  15. LOSS OR THEFT.  BENDER REALTY, INC. will not be responsible for loss or theft of money or valuables of any kind.
  16. PHONE CALLS. OUTGOING LONG DISTANCE CALLS MUST BE MADE BY USING A CALLING CARD OR CREDIT CARD. No charge for local calls. Long distance charges placed on unit telephones will be subject to a $10 service charge.
  17. KEYS. Only two (2) keys per rental unit will be issued to rental guests.  If keys are lost, guests will be charged $25 which will be deducted from your deposit.  If you become locked out, there will be a $25 service charge deducted from your deposit if a Bender Realty employee is called after hours to assist in entry.
  18. PARKING. Some properties only allow one (1) vehicle regardless of unit size.  Parking fees may also apply at certain properties.  A maximum of two (2) vehicles will be allowed at all other properties.  Please inquire before arrival for parking policies.  Vehicles without parking passes are subject to towing at owner's expense.  No boats, trailers or RVs allowed.
  19. TROPICAL STORM POLICIES. Before you arrive: If an official evacuation is ordered, you will receive a refund of your deposit and prepaid rent.  If no evacuation is ordered but you choose to cancel, your deposit will be forfeited. If you are already here: If an official evacuation is ordered, you will be charged at a daily rate for your stay and any prepaid balance will be refunded. If no evacuation is ordered but you choose to depart, your rent will not be refunded under the terms and conditions of your rental contract.
  20. DAMAGES. If during your stay any breakage or damage occurs in the unit, please contact our office immediately. Any cost for damage repair or breakage replacement will be collected at time of departure and is the responsibility of the guest. DO NOT MOVE FURNITURE INSIDE THE UNITS OR MOVE ANY ITEMS (PARTICULARLY KITCHEN ITEMS) FROM ONE UNIT TO ANOTHER.
  21. TENTATIVE ADVANCE RESERVATIONS. We are able to make tentative advance reservations for future time periods. All advance reservations are subject to rates applicable at the time of actual reservation arrival and the availability of units year to year. No future-year reservations will be honored at previous- year rates. Subject to owner's reservations.
  22. UNIT FOR SALE. In the event that the condominium you are renting is on the market for sale, we may find the need to show the property during your visit. We will make every effort to schedule the showing at a convenient time and not interrupt your vacation.
  23. PRINTING ERROR. Although every precaution is taken by Bender Realty, Inc., errors in price and description can occur in printing. We reserve the right to correct such errors; however, we cannot give refunds and are not responsible for changes in furnishings and equipment by the owners. Rates, descriptions and availability are subject to change without notice.
